Terms of Service

Welcome to Wordyz! These Terms of Service ("Terms") govern your use of the Wordyz mobile application and website (collectively, the "Service") operated by Wordyz ("we," "us," or "our").

1. Acceptance of Terms

By accessing or using Wordyz, you confirm that you:

• Are at least 13 years old (or the minimum age in your jurisdiction).
• Have the legal capacity to enter into these Terms.
• Agree to be bound by these Terms and our Privacy Policy.

2. Description of Service

Wordyz is a daily word puzzle game. Each day features one puzzle consisting of three words (5 letters, 6 letters, and 7 letters) all linked by a common category. The Service includes:

• Daily Puzzles: One new puzzle per day, same for all players worldwide.
• Three-Word Challenge: Solve words of increasing length (5, 6, then 7 letters) sharing a theme.
• Statistics & Streaks: Track your performance, maintain daily streaks, and view history.
• Free Tier: Access puzzles with advertisements between games.
• Premium Tier: Ad-free experience and additional features via in-app purchase.

3. Beta/Early Access

Wordyz may offer beta or early access versions of the Service. By participating, you acknowledge that:

• Beta features may be incomplete, contain bugs, or change without notice.
• Your progress or data during beta may be reset upon full release.
• Beta access may be revoked at any time.
• Feedback provided during beta may be used to improve the Service.

4. Account Registration

To access certain features, you must create an account using Google Sign-In, Sign in with Apple, or email/password. You agree to:

• Provide accurate and complete information.
• Maintain the security of your account credentials.
• Promptly notify us of any unauthorized access.
• Accept responsibility for all activities under your account.
• Not create multiple accounts to abuse features or promotions.

We reserve the right to suspend or terminate accounts that violate these Terms.

4.1 Account Deletion

You may delete your account at any time through Settings → Privacy → "Delete My Account" in the app. Upon deletion:

• All your personal data will be permanently removed from our servers.
• Your game history, statistics, and achievements will be deleted.
• Any active subscriptions should be cancelled separately through your app store.
• This action is irreversible.

4.2 Data Export

You may export your data at any time through Settings → Privacy → "Export My Data" in the app. This provides a copy of your personal information in a portable format.

5. User Conduct

You agree NOT to:

• Use cheats, exploits, automation software, bots, or hacks.
• Attempt to manipulate game statistics or leaderboards.
• Interfere with or disrupt the Service or servers.
• Reverse engineer, decompile, or disassemble the app.
• Use the Service for any illegal or unauthorized purpose.
• Harass, abuse, or harm other users.
• Create multiple accounts to abuse features or promotions.
• Share puzzles or answers in ways that spoil the experience for others.

6. In-App Purchases & Payments

6.1 Premium Features

Wordyz offers optional in-app purchases including:

• Ad-Free Experience: Remove all advertisements permanently.
• Premium Subscription: Access to exclusive features and content.

6.2 Payment Processing

Payments are processed through:

• Apple App Store: For iOS purchases.
• Google Play Store: For Android purchases.

Prices are displayed in your local currency and include applicable taxes. We do not store your payment information.

6.3 Subscriptions

• Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date.
• You can manage and cancel subscriptions through your device's app store settings.
• iOS: Settings → Apple ID → Subscriptions
• Android: Play Store → Menu → Subscriptions

6.4 Refunds

Refund policies are determined by your payment provider:

• Apple: Request a refund from Apple
• Google: Request a refund from Google Play

We do not directly process refunds for app store purchases.

6.5 Virtual Items

Any virtual items, currency, or premium features:

• Have no real-world monetary value.
• Cannot be transferred, sold, or exchanged outside the Service.
• May be modified or discontinued at our discretion.
• Are non-refundable except as required by law.

7. Intellectual Property

All content in Wordyz, including but not limited to:

• Game design, mechanics, and puzzles.
• Graphics, logos, and visual elements.
• Software code and algorithms.
• Text, sounds, and music.

...is owned by Wordyz or our licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

8. User Content & Feedback

If you submit any content to the Service (such as feedback, suggestions, or bug reports), you grant us a non-exclusive, worldwide, royalty-free license to use, modify, and display that content to improve the Service.

9. Third-Party Services

The Service integrates with third-party services including:

• Firebase (Google): Authentication, database, analytics, crash reporting, and push notifications.
• Google AdMob: Advertising for free-tier users.
• Google/Apple Sign-In: Account authentication.

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of third-party providers.

10. Push Notifications

The Service may send push notifications for:

• Daily puzzle reminders.
• Streak maintenance alerts.
• Important service announcements.

You can disable notifications at any time through your device settings or within the app at Settings → Notifications.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE:

• The Service will be uninterrupted or error-free.
• Defects will be corrected.
• The Service is free of viruses or harmful components.
• Results or accuracy of any information.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WORDYZ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or $100 USD, whichever is greater.

13. Indemnification

You agree to indemnify and hold harmless Wordyz and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

14. Dispute Resolution & Arbitration

14.1 Informal Resolution

Before filing any formal dispute, you agree to contact us at support@wordyz.com and attempt to resolve the dispute informally for at least 30 days.

14.2 Binding Arbitration

If informal resolution fails, any dispute shall be resolved through binding arbitration rather than in court, except for claims that qualify for small claims court. Arbitration shall be conducted in accordance with the rules of the American Arbitration Association (AAA).

14.3 Class Action Waiver

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive any right to participate in class action lawsuits or class-wide arbitration.

14.4 Opt-Out

You may opt out of this arbitration agreement by sending written notice to support@wordyz.com within 30 days of first using the Service. Include your name, email, and a statement that you wish to opt out of arbitration.

15. Modifications to Service & Terms

We reserve the right to:

• Modify, suspend, or discontinue the Service at any time.
• Update these Terms with reasonable notice.
• Change pricing for premium features with advance notice.
• Reset beta progress or features upon full release.

We will notify you of material changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the updated Terms.

16. Termination

You may stop using the Service at any time by deleting your account. We may suspend or terminate your access if you violate these Terms. Upon termination:

• Your right to use the Service ceases immediately.
• We may delete your account and data (subject to legal retention requirements).
• You remain liable for any outstanding payments.
• Provisions that should survive termination will remain in effect (including arbitration, limitation of liability, and intellectual property).

17. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

For users in the European Union: Nothing in these Terms affects your rights under mandatory EU consumer protection laws. You may bring legal proceedings in your country of residence.

18. Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, pandemic, power outages, or internet service failures.

19. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable.

20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Wordyz regarding the Service. They supersede any prior agreements or understandings.
